Expert qualification commissions for “Forensic psychiatric examination” and “Forensic psychological examination”

Under Article 17 of the Law of Ukraine “On Forensic Examination” expert qualification commissions are formed to resolve issues related to the assignment of qualifications to forensic experts in the relevant field of expertise, confirmation of advanced training of forensic experts in the relevant field of expertise, assignment of qualification classes, temporary suspension, renewal, and termination of the right to conduct forensic examinations in the relevant expert specialty, as well as disciplinary responsibility of forensic experts.

Expert qualification commissions for Forensic Psychiatric Examination and Forensic Psychological Examination at the Ministry of Health of Ukraine shall act under Regulations on expert qualification commissions and Procedure for certification of forensic experts, approved by Order of the Ministry of Health of Ukraine of 23.12.2025 №1935.

Role of the expert qualification commissions:

  • to consider the issue of granting the qualification of a forensic expert in the expert specialties of “Forensic Psychiatric Examination” and “Forensic Psychological Examination”
  • to consider the issue of confirming the advanced training of a forensic psychiatric expert and a forensic psychologist
  • to assign a qualification class to a forensic psychiatrist and a forensic psychologist
  • to consider the issue of temporary suspension, renewal, and termination of the right of a forensic psychiatrist to conduct forensic examinations in the expert specialty of “Forensic Psychiatric Examination” and of a forensic psychologist to conduct forensic examinations in the expert specialty of “Forensic Psychological Examination”
  • to consider the issue of disciplinary liability of the forensic psychiatrist and forensic psychologist
  • to issue a certificate of qualification as a forensic expert (or a duplicate thereof) in the expert specialties of “Forensic Psychiatric Examination” and “Forensic Psychological Examination”, a sample and description of which are provided in Annex 1 and Annex 2 to the certification procedure

The list of members of the expert qualification commissions (6 persons) is approved by an order of the Ministry of Health of Ukraine, and the term of office of the members of these commissions shall not exceed five years and two consecutive terms. Thus, Order of the Ministry of Health of Ukraine of 09.03.2026 №300 approved the membership of expert qualification commissions at the Ministry of Health as follows:

Decisions of expert qualification commissions are made by a simple majority of members present at the meeting, by open ballot, and they are formalized in accordance with Annexes 1 and 2 to the Regulations on expert qualification commissions. The minutes of the meeting shall include the comments and remarks of the members of the relevant expert qualification commission who disagree with the overall result of the vote. In the event of a draw, the Chair of the commission shall have the casting vote.
